摘要
宪政的理论和实践为何最初源于西方而不是中国?从宪政的民主、法治、人权等要素出发,与中国古代的民本、人治、家族本位两相对比,探寻中国古代无法生发宪政观念的缘由,并由此论证中国传统法律文化的基本特征。
Why did Constitutional theory and practice derive from the west rather than China？The paper will compare democracy, the rule by law, human fights and other elements in west with democracy, the rule by man and family ethical principles in ancient China,in order to explore the reason why Constitution didn＇ t derive from ancient China and demonstrate the basic features of Chinese traditional law euhure.
