摘要
商鞅关于法、法的制定与公布、法律的执行等思想,表面上和现代"法治"观念有某些相似之处,然而,其中所包含的专制色彩、重刑主义、对自由的禁锢和对人权的蔑视,凸显出其与现代"法治"在本质上的截然不同。为此,在法学领域中应当摒弃用"法治"一词来表述商鞅和法家的思想,避免不必要的误解。
Shang Yang＇s thought on law, law--making and law promulgation and law implementation and so on, seem to have some similarities to the modern concept of ＂government by law＂, but they are entirely different in despotic coloring, severe sentence principle, imprisonment of the free and human rights despising, which highlights their difference from the ＂the government by law＂ in the modern times. Therefore, in the field of law the expression of ＂ government by law＂, which expresses the thought of Shang Yang and Legalists, should be abandoned to avoid unnecessary misunderstanding.
