摘要
针对"特色服务"的创意很难受到法律规制的现象,文章从知识产权法之外的其他法律和知识产权法多角度进行了分析探讨,提出应当给予"特色服务"知识产权法的保护的观点,以及在对其保护中应注意的问题。
In practice, characteristic service plays a key role in commercial competitions. The uniqueness and novelty of the service are the most important factors to attract the consumers, but the action of imitation is hard to be ruled by certain laws. This article discusses the nature of the characteristic service and the necessity and possibility of its protections from the law of IPR.
