摘要
经济法产生的直接原因是为了克服市场失灵,而非政府失灵,严格说来,政府失灵问题决非经济法所能解决,否则会更加桎梏经济法的发展、完善进程,而不是相反。经济法确实是政府干预经济的准则,但也不能笼统地把经济法定性为"干预政府之法"。看清经济法的性质,乃是构建完善经济法治建设事半功倍之良策。
The fundamental cause of the economic law is to overcome Market Failure, not Government Failure. The government failure problems can not he setded by economic law, otherwise, it will hinder the derelopment and improvement process of economic law. In fact, the economic law is the rule of intervention by government, but not the law of intervention in government.
