摘要
察机关作为国家的法律监督机关,行使量刑建议权是强化法律监督职能作用、维护社会公平正义的重要手段。文章从分析量刑建议的存在根据入手,从构建量刑建议制度的认识基础,完善立法与配套制度,以及构建保障机制、科学测评机制和运行机制等多方面探讨制度构建。
As the country＇s legal supervisory authority, the procuratorial organs has the right to exercise sentencing recommendation, which is to strengthen the role of legal supervision functions and is an important means to safeguard social fairness and justice. Analyzing the existence basis of proposal for sentencing, the author discusses the system construction from many perspectives such as the construction of the sentence from the understanding of the basis of the proposed system, the improvement of legislation system and supporting systems, as well as building a security mechanism, the scientific evaluation of mechanisms and operating mechanisms.
