摘要
叶适是南宋永嘉学派的集大成者,历史上著名的哲学家、思想家。叶适思想体系中的法律思想有其独特之处,主要表现出对事功思想和哲学思想具有较大的依附性。在当前对此研究较少的情况下,以此作为切入点,可以衡定其思想价值,并厘清其法律思想的存疑,即把叶适法律思想当作一个客观存在的现象,去解释它存在的理由和原因。客观、公正地评价叶适法律思想的实际地位,可以发现其法律思想的历史价值。
YE Shi, a master of Yongjia School in South Song Dynasty, is a famous philosopher and thinker. The law thought in his ideological system has its uniqueness. It shows great reliance on utilitarianism and philosophic thought. As less research has been made on this issue at present, the start of it can determine its ideological thought and clarify the problem on its law thought. In other words, regarded as an objective being, YE Shi＇s law thought is applied to interpret the reason for its existence. Evaluating YE Shi＇s law thought in an objective and fair way can find its historical value.
