摘要
北宋仁宗至和年间发生在潭州"分买珠子案"是一起地方官员因产生贪猥之心、违法分买客死商人珠子,却因法律对商人的合法权益加以保护而未能得逞的民事案件。这一个案,反映了商品与市场、交通发展、商业政策等经济史信息,体现了宋代财产所有权、继承权等法律制度方面的时代特色。
Pearl Partition Case occurred in Tanzhou in the realm of Zhihe years of the Northern Song Dynasty, which was a case of civil disputes that corrupt local officials lusted for pearl and bought dead traders＇ pearl illicitly. Because the law protected the legitimate rights and the interests of traders, which made the local officials failed to divide traders＇ property privately. This case reflected much economic information, including commodity and market and the development of transportation. It also reflected some information in the times of Northern Song Dynasty, such as ownership of property, the right of inheritance and other legal systems.
