摘要
随着市场经济的快速发展,不动产征收已成为社会经济生活中的常见现象。但在我国现行立法中,由于立法思想上对私人财产权保护的轻视,导致不动产征收中经常发生片面强调征收者利益而未能给被征收者利益以合理保护的情况。从澄清不动产征收的概念入手,探讨城市部分的不动产征收补偿问题,认为目前城市不动产征收的范围和补偿标准不合理、补偿方式单一,并通过对国外土地征收补偿的范围、标准的对比分析,提出了转变观念、扩大补偿范围、确定合理标准、改进补偿方式等完善的对策和建议。
With rapid development of market economy, real estate levy has become a common phenomenon. Owing to neglect of protection of private property in legislation, stress is often put on interests of tax collectors rather than protection of people levied. The paper begins with the concept of real estate an discusses some compensation problems in real estate levy, the levy range, compensation standards and ways. Meanwhile, compared to those in foreign countries, countermeasures and suggestions are given such as change of ideas, extension of compensation range, and determination of a reasonable standard and improvement of compensation ways.
