摘要
道路交通事故责任是由于道路交通事故而发生的责任人对受害人应当承担的侵权赔偿责任,即道路交通事故发生之后,造成了受害人的人身伤亡或者财产损失,事故责任人对受害人依照侵权责任法的规定,应当承担的侵权损害赔偿责任。其构成要素为车的要素、人的要素、道路与交通的要素和事故与责任的要素。
The liability of road traffic accidents is the liability that the infringer should bear to the victim of the road traffic accidents, that is, after the occurrence of road traffic accidents which resulted in the victim＇s personal injury or property damage, the person who is liable for the accident in accordance with the torts law, should assume liability for the damage. The constituent elements are vehicle, person, road and traffic factor, as well as accident and liability elements.
