摘要
索赔是工程合同管理的重要手段。在承包商的费用索赔中,应包括成本索赔和利润索赔,成本索赔只能保证承包商不致亏损,而成功的利润索赔才能使承包商在保本的基础上盈利。本文以法学、经济学原理,结合我国现行施工合同条件,就承包人的利润索赔做一些深入的探讨。
Contract claim is an important means of project contract mangement. The contractor＇s claim for expense compensation should include cost claim and profit claim. It is profit claim not cost claim that brings contractor＇s payoff. Combined with China＇s current conditions of contruction contract, this article dicussed the contractor＇s claim for profit according to legal and economic theories.
