摘要
追求和谐是人类社会永恒的主题,是中华传统文化的古老真理和基本理念,其核心价值是"和为贵"、"和谐共生"与"和而不同"的"贵和"思想。当今我们构建和谐社会的重要组成部分和基础是建设和谐婚姻家庭,目前我们正处于新的、快速的社会转型期,婚姻家庭领域出现了许多新问题、新矛盾,已严重影响了社会的和谐与稳定,究其主要原因有全球化现代化背景下的家庭伦理关系的解构与重建、个体的人格因素、传统家族伦理道德的沦丧与传统家庭代际关系的破坏、经济理性对家庭核心价值的入侵、过度强调以权利理论全面建构家庭制度及婚姻家庭法律环境的不完善等。对此我们应力倡并践行"贵和"理念,崇尚并培育宽容与多元主义的人文精神,树立与弘扬尊重人性尊严及包容他人的理念,重构婚姻家庭关系的伦理价值体系,重申与坚守婚姻家庭法的伦理性,建构与完善婚姻家庭的法律环境,真正实现婚姻家庭与社会的和谐、健康。
The pursuit of harmony, the eternal theme of human society, is an ancient and basic concept of traditional Chinese culture, and its core value refers to the ideas of “harmony is wealth” ,“harmonious coexistence” and “divergent hut harmonious”. The important part and base of the building of harmonious society of China is to set up harmonious marriage and family. We are now in the stage of new,rapid social transition and thus in the field of marriage and family there occur many new problems and contradictions which have seriously affected the harmony and stability of society. And the main reasons accountable for it are the deconstruetion and reconstruction of familial ethics, individual personality, the rtaditional family, decadence of traditional familial morality and the destruction Of inter-generational relations, the invasion of economic rationality to the core values of family, over-emphasis of the rights in the comprehensive building of family mechanism and the imperfect of law environment for marriage and family. Therefore we should, in order to realize the social harmony and health of marriage,family and society, propose and implement the philosophy of “harmony”, advocate and foster the humanistic spirits of tolerance and pluralism, establish and promote the ideas of resprcting human dignity and accommodating others, reconstruct the value system of marriage and family relations, reiterate and uphold the nature of ethics in marriage and family law, build and improve the law environment of marriage and family.
