摘要
在我国城市建设和发展的过程中,"拆迁"成为矛盾集中而且冲突频发的事件。城市改造的顺利实施和由"拆迁"引发的矛盾的合理解决具有重要的意义。本文首先在现行土地制度下分析了拆迁的动力来源,探讨了对拆迁相关利益方"帕累托改进"的实现,分析了现有的城市拆迁制度,设计了基于帕累托改进的城市拆迁制度,提出了在权力均衡的制度框架下实现利益均衡的城市拆迁的二次补偿论。
During the urban construction and development in China, demolition always causes conflicts. It is very important to undergo urban reconstruction and meanwhile resolve the conflicts caused by demolition. The paper first analyzes the motive source of urban demolition under the present land institutions, and then makes an inquiry into the realization of Pareto Optimize of the relevant parties in urban demolition; after analyzing the present urban demolition institutions, puts forward the conditions to realize Pareto Optimize, designs new urban demolition institutions based on Pareto Optimize, proposes two-time compensation theory to balance the benefits of the relevant parties, and at last presents the policy meaning of the paper.
