摘要
反不正当竞争，必须准确识别不正当竞争行为。从唯物辩证法关于质、量、度的理论的角度去研究什么是不正当竞争行为，有助于促进在这个领域中立法、执法、守法各个环节的完善。本文通过对不正当竞争行为整体的质和个体的质的分析，对不正当竞争行为量的规定性的重要性的认识，对不正当竞争行为度的特点的研究，提出识别不正当竞争行为，把握其质是基础，把握其量才能使认识精确。
In the struggle against illegal competition, illegal competative action must be precisely distinguished . A study of what is illegal competative action in the light of the theories of materialist dialectics on nature, amount and degree will help to perfect the law making, law enforcement and law abiding in this realm. Through analysis of the nature of the whole illegal competative action or a particular illegal competative action through grasping the imporance of the prescription of the amount of illegal competative action, and through the srudy of the characreristics of the degree of illegal competative action, this paper holds that in distinguishing illegal competative action, a good grasp of its nature is the base, a good grasp of its amount is the approach to correct understanding ,and a good grasp of its degree is the key.
