摘要
人民检察院讯问职务犯罪嫌疑人实行全程同步录音录像的根本目的,是为了规范执法行为、提高执法水平和办案质量,其性质属于侦查行为。在庭审过程中,当被告人、辩护人对讯问活动提出异议的,公诉人应当提请审判长当庭播放讯问全程同步录音录像。职务犯罪讯问全程同步录音录像的内容涉及限制公民人身自由,犯罪嫌疑人、其亲属、辩护律师以及其他法律工作者都有权利知晓相关规定,最高人民检察院理应对外公布。
The synchronal audio -visual material which the People＇s Procuratorate interrogates the criminal suspect aims basically to restrict the conduct of the investigators within criminal procedure, and the process of recording has the nature of the investigation. On trial, when the defendant or lawyer opposites the interrogation, the public prosecutor should play the synchronal audio - visual material within the permission by the chief justice. The synchronal audio - visual material relates to restriction of personal freedom, hence the suspects and their family, the defense lawyer and other members of the legal profession have the right to know. Therefore, the Supreme People＇s Procuratorate shall open these materials to public.
