摘要
由于知识产权的大部分构成成本凝结并沉淀于研发活动,传统的测试市场势力的指标对之失灵。知识产权本身虽不构成反垄断法意义上的市场势力,却促进着产品的差异化,从而有助于权利人市场势力的形成或强化。在评估知识产权产品的市场势力时,不仅要界定产品市场和地域市场,还要分析技术市场和发明市场。
The traditional criteria for measuring market power is impossible to function well concerning the cases of intellectual property rights because the most significant costs of the intellectual property products are generally fixed and fully sunk during the courses of research and development. The intellectual property itself doesn’t form market power in Anti-Monopoly Law, but can facilitate product differentiation and make its owners for getting or strengthening their market power. Therefore, when assessing the market power of intellectual property products it is necessary to define product and geographic dimensions and to estimate technology and innovation markets as well.
