摘要
《刑法修正案》(七)草案第11条新增了贿赂犯罪的内容,这有助于严密抗制贿赂犯罪的刑事法网。但是,就新增条文贿赂犯罪内容的罪名确认,存在着不同的看法。在充分分析贿赂新增条文罪名确定的争议后,我们认为,宜增设影响力交易罪来全面规制间接受贿行为,在此基础上,提出了增设影响力交易罪的具体路径。
＂The amendment of the Penal Code＂（draft）Clause increasesthe new crime of bribery, which contributes to the strict web of anti-bribery crime of criminal law. However,there are different views on charge confirm on the new provisions on bribery. After the full analysis of the controversy on charges of the new provisions of the bribery,we believe that we should comprehensively regulate indirect bribery behavior by devising the crime of influence trading, on this basis;we put forward the specific path to the crime of influence trading.
