摘要
目前,住宅小区内发生的违法犯罪行为对业主的人身、财产皆造成严重的损害,业主要求物业服务企业承担赔偿责任,因而产生新型纠纷.由于立法滞后,现有的法律法规对该责任没有作出明确的规定,因此在实践中,不同的法院对同类的案件往往做出截然不同的判决.针对这一问题,首先从理论上分析物业公司承担赔偿责任的性质,在此基础上对该责任的构成要件进行分析,以期为司法机关、物业服务企业对该类案件的处理提供借鉴.
At present, the illegal activities occurred in residential quarters make great personal,property damage to the owners. The owners require property services business be liable for reimbursement liability,which has become a new dispute. As legislation lags behind,there is no specific regulation to this responsibility. So in practice ,different courts will often make different judgments to similar cases. In response to this problem, the nature of the reimbursement liability taken by the property services enterprises is analyzed in theory. On this basis,the attribution in theory and elements composition of the responsibility are analyzed to provide a reference on the treatment of such cases by the judiciary and the property manage- ment companies.
