摘要
目前,在社会主义公有制背景下,我国面临国有资产"主体虚化"的问题,如何协调国家所有权与充分发挥国有资产效益之间的冲突,一直以来未得到妥善解决。要解决这一问题,可以从古罗马的占有制度以及其对公有物和共用物的法律调整中寻找些许启示,以重新构建我国国有资产的权利分配体系。
Under the current socialist public ownership background, China national assets are confronted with the problem of subject grammaticalization, while how to coordinate the contradiction between national ownership and giving full play to national assets＇ returns has not been effectively resolved. In order to settle the above problem, we can dram some lessons from Roman＇s possession system and legal adjustment of public property and common property as to reconstruct China national assets＇ right distribution system.
