摘要
公正不仅要实现,而且要以看得见的方式实现。这就要求司法的过程要公开与透明,要遵循一定的步骤与程序。而程序的有序、理性进行,需要依赖一定的机制来确认和规范。量刑均衡的实现关键是过程的机制化。量刑过程中存在的偏差问题,既有制度和方法的因素,也有习惯和人文的因素。解决之策,即从立法解释上分割量刑幅度,从操作方法上制定权威的量刑规则,从工作程序上增加量刑演算报告,从队伍建设上统一刑事法官素养。
Justice should not only be realized, but also be realized in a visible way. This demands that the process of judicature must be open and follow certain procedures. Carrying out such judicature process needs certain system to confirm it. Institutionalization of the process is crucial to realize balance of the pen- alty measurement. The problem of penalty deviation has its system and method factors, and also custom and culture factors. There are four ways of solving it. First, break up the width of the penalty measurement from the perspective of legislation interpretation. Second, formulate authoritative rules of the penalty measurement from the perspective of operating method. Third, increase penalty measurement report in daily work. Fourth, unite the judges＇ quality from the perspective of team construction.
