摘要
商品房价格欺诈行为属于一般侵权行为,其构成要件仍然是违法行为、损害结果、因果关系和主观过错,但也有其自身的特点。作为一种违法行为,商品房价格欺诈行为主要是违反明码标价的法定义务的行为;其损害后果应包括购房消费者机会利益的损失;对商品房价格欺诈行为因果关系的认定应采用推定因果关系规则;在特定情况下,如同故意一样,过失也应当是商品房价格欺诈行为的主观要件。
The behavior of price-cheating in commodity apartment is a general tort. The component parts include illegal act, damage , causation and fault, but it has its own characteristics. The behavior of price-cheating in commodity apartment is mainly a behavior violating the duty of displaing price tag pubicly. It should take putative rule to comfirm causation of the behavior. In special conditions, negligence is also the subjective component part such as intent.
