摘要
德国犯罪论体系在大陆法系国家中是最具代表性的一种体系,在当代世界范围内产生着较大影响。多年来我国刑法学界对该体系从不同角度进行了深入研究,对完善我国刑法学理论起了重要的推动作用。但是,德国犯罪论体系毕竟是在德国的历史、文化及制度背景下生成,与法治初创时期的中国国情存有诸多隔膜之处。注意到这一点,无疑对建构科学、合理、实用的中国犯罪论体系,有着宏观的启示与导向意义。
German criminology system which is the most representative among the countries of continental legal system has great influence all over the world. Since years ago China criminal law scholars have researched into German system from various aspects, and contributed to the improvement of Chinese criminal law. However, German criminology system is derived from the historical, cultural and systematic background of Germany, and has much inapplicability to the situation of China which is at the ini- tial stages of the rule of law. Pay attention to this inapplicability has macroscopic significance of inspiration and orientation to the construction a scientific, reasonable and practical criminology system of China.
