摘要
《关于适用〈中华人民共和国婚姻法若干问题的解释(二)〉》虽然对彩礼的返还作出了规定,但由于规定过于简略,远远不能满足现实生活的需要,而且我国法律并未对嫁妆的问题作出相应规定。本文从利益平衡的角度讨论了彩礼的范围、性质和彩礼返还制度的缺陷,并提出了关于完善彩礼和嫁妆返还制度的立法建议。
Although ＂Law of Marriage Explanation （Two）＂, has stipulated the return of the betrothal gifts, the contents of the law are too simple to meet the needs in real life. Moreover, the law has not made a relative stipulation to the trousseau. Using the method of benefit＇s balance, this article discusses the limitation and nature of the betrothal gifts, the defect of betrothal gifts＇ returning system and proposes a legislative suggestion of improving the returning system of betrothal gifts and trousseau.
