摘要
综观世界各国环境责任保险制度的立法和司法实践,结合我国环境污染责任保险的立法现状和存在的主要问题,提出了以强制环境责任保险为主、任意性责任保险为辅,扩大责任保险范围、明确环境责任保险费率、索赔时效和责任限额,确定除外责任和免责条款、政府支持的环境污染责任保险制度的具体设想。
By making a comprehensive view on the legislative and judicatory practice of environmental liability insurance system in different countries around the world and combining the existing legislative situation and major problems of environmental pollution liability insurance in our country, this thesis puts forward a specific assumption of environmental pollution liability insurance system that takes compulsory environmental and obligatory insurance as a major measure, and optional liability insurance as subsidiary measure, enlarges the scope of liability insurance, specifies insurance rate of environmental liability insurance, claim prescription and liability limit, and establishes clauses of excluded liability, liability exemption and governmental support.
