摘要
婚约是我国几千年来的婚嫁风俗。然而,订立了婚约,并不等于双方将来就一定结婚。一旦双方结婚不成,就会对此期间的财产往来发生争议。虽然我国已出台了最高人民法院关于适用《婚姻法》若干问题的解释,但要在司法实践中正确认识和处理此类纠纷,仍有许多问题需要进一步明析。
Engagement is the traditional custom of China for several thousand years. However, signing the engagement does not mean that the both sides will certainly get married in the future, once the engagement is broken, there may happen the dispute which relates to the property that contacts with each other. Although our government has released the issues of Supreme People＇s Court which are suitable to explain several certain problems in ＂ Marriage Law＂, there still lays many ones that need to be analyzed deeply in the judicial practice. With the purpose of getting fully comprehend and mastery of the cases of this kind, this paper tries to make a superficial comment on this point.
