摘要
进口权能否直接阻止平行进口是一个有争议的问题。本文认为,从现有国际条约和各国国内立法与司法实践看,很难直接根据进口权阻止平行进口,进口权能否阻止平行进口取决于其与权利穷尽原则的关系。
It is arguable whether import right can be used to block parallel importation. The approach of this article is that, based on existing international treaties and national legislations and judicial practices, import right can hardly be directly invoked to block parallel importation. Whether import right can be used to prohibit parallel importation depends on the relationship between it and the doctrine of exhaustion of rights.
