摘要
在《身份社会与伦理法律》中，梁治平曾经写道：虽然瞿同祖先生的《中国法律与中国社会》初版於1947年，但是今天读来仍能启入神智，令人耳目一新。这不是偶然的，它与瞿同祖采用的独特研究方法与丰富文献资料密切相关。只是，今天看来，本书的不足也不必讳言．而其原因乃是，作者对以下两个方面强调不够：第一，中国古代社会是身份社会：第二，中国古代法律是伦理法律。
