摘要
中国的传统文化可以说是国家主义、集体主义、宗法社会一统天下的社会,相应的中国传统法律文化一直是一种公法文化。在长期的个人压制过后,中国开始出现个人主义的思潮。基于我国法律文化的传统和当前法治建设的现状,集体主义价值观仍然应当是我国法治建设的基石。
China is experiencing a transition period in social and cultural transformation in which both collectivism and individualism exist. We must judge them from specific historical and social conditions.Based on Chian＇s legal culture tradition and the present legal consturction, the collectivism value is still the foundation in the proceed of legal construction of our country.
