摘要
P2P技术为网络信息服务提供了新的机遇,同时也对传统的知识产权制度提出了新的挑战。基于P2P技术的网络信息服务具有信息与服务的高度共享性、信息提供的多样性、信息服务的不稳定性、信息内容质量的不可靠性等特点。目前P2P网络信息服务中的侵权问题主要有信息网络传播、下载复制、超链接和编译等引发的知识产权问题。文章针对P2P网络信息服务中存在的知识产权问题,提出了P2P网络信息服务中规避知识产权风险的相关对策:即要完善版本法的修订、采取各种形式的技术保护措施、依托著作权集体管理制度、加强各层面的合作、构建P2P网络服务收费机制等。
P2P technology has brought new opportunities and challenges on network information services. The P2P network： information services have the characters, which include high sharing of information, providing variety information, instability of information services, and uncertainty of information. At present, the P2P network information services may cause many intellectual property rights, such as information spread by network, information download and copy, information hyperlink and edit. In the end, this paper put forward accordingly counter--measures to avoid the risks of invading intellectual property rights, which are perfecting the laws of intellectual property rights, exercising many technology measures, adopting collectivity managing system, strengthening cooperating of many lays,and forming charging mechanism.
