摘要
在职务犯罪日益智能化、科技化的新形势下,技术侦查是一种有效的侦查手段。但技术侦查是以牺牲公民权益为代价的手段,应寻找控制犯罪和保障人权之间的平衡点,对技术侦查运用的正当性进行诠释。该文着重从技术侦查措施设立的必要性和技术侦查在法律规范中的体现这两个方面,对技术侦查的正当性进行探讨。
Faced with the new methods of duty crimes which are more and more intelligentized and technicalized, technical investigation is considered as an effective means of investigative techniques. However, this kind of investigation is also regarded as a method at the expense of civil rights. Therefore, the present paper makes a discussion on how to find out the balance between the criminal control and the protection of human rights, and how to interpret the legitimacy of using the technical investigation from the perspectives of the necessity of taking the technical measures and its feasibility in the legal norms.
