摘要
驰名商标应当根据案情实际需要考虑是否认定。对商标驰名事实的采纳应当坚持权利主张的原则,受到关注的应当是系争商标在中国大陆的使用和宣传情况,而不是其他地域。在商标侵权诉讼中商品或服务是否类似不是一个孤立和静止的问题,对服务类似与否的司法审查应当比较和考量服务的目的、内容、方式、对象等因素,以相关公众服务的一般认识进行综合判断。
Recognition of famous brands should be done as the case requires. In doing the work, it is important to insist upon the place of right. The point of concern is how the famous brand has been used and publicized in China's Mainland and not in may other areas. Whether commodities or services are similar is not an isolated phenomenon and should be considered in a comprehensive way.
