摘要
新闻侵权严重损害公民和法人的人格权。由于新闻自由权与人格权的矛盾,加之相关法律的不完善,实践中很难平衡两者利益。通过实际案例,分析两者冲突的现状及产生的原因,提出利益平衡的原则、新闻真实性认定标准、新闻侵权的举证责任和免责事由,以平衡两者之间的利益保护。
News tort is a serious infringement of a citizen and a legal person＇s personal rights. Because of the contradiction between freedom of news and personal rights, and imperfection of relevant law, it＇ s difficult to balance the interests between the two. Through actual cases, the paper has analysed the conflict between the status quo and the causes, and put forward the principle ofbalance of interests , the criteria to confirm the truth of the news, the liability of proofing in news tort and exemptions to strike a balance between the two in the interests protection.
