摘要
我国行政机关滥用行政自由裁量权的问题比较突出。行政程序对行政自由裁量权滥用具有控制功能,是规制行政自由裁量权滥用的妥当方法之一,应为行政自由裁量权的行使设定程序规则,尽快构建我国行政程序法体系,以更有利于对行政自由裁量权的规制。
That the administrative organs abuse the administrative discretion has become a prominent problem. The administrative procedure has the controlling function to the administrative discretion, which is one of the good methods to control the administrative discretion abusing. We should set the procedure regulation for the administrative discretion and construct the administrative procedure system for the specification of the administrative discretion.
