摘要 EPC总承包是一种运用于电力建设等大型项目中的较先进的工程建设组织方式,业主在EPC总承包模式下应该扮演什么样的角色、如何定位等,还缺乏系统的理论支持,在实践中存在业主权利畸形或虚化的倾向。这将增加业主的风险,影响合同目的和业主利益的实现,制约了EPC总承包模式的发展。基于对业主权利的分析,对中国目前EPC总承包建设模式的应用情况与FIDIC总承包合同条件进行对比和论述,提出应对和解决问题的方法和建议。 While the EPC contract is adopted for large power projects as an advanced construction organization mode, it is found that under the EPC mode, the position of the owner and the role he plays are often ambiguous due to lack of systematic theoretical support. In practice, the owner's rights are prone to be handicapped or marginalized. This practice increases the owner' s risk and exerts negative effects on the contract execution and realization of the owner' s interest, and at the same time, prevents the mode from sound development. This paper, based upon thorough analysis of the owner's rights, discusses the current situation of the EPC application in China, compares EPC with FIDIC, and finally puts forward suggestions on the counter measures and solutions.
