摘要
小产权房是指在农民集体土地上建设的房屋。小产权房主要分布在县(区)级行政区划范围内,因没有缴纳土地出让金等费用,而不能获得由国家房管部门颁发的产权证,只能得到村委会或乡镇政府颁发的"产权"证明,故称之为"小产权房",也叫"乡产权房"。现阶段,小产权房有违土地管理等法律规定,属于"违规建筑",同时也不符合国家相关产业政策。若任其肆意发展,势必影响到整个房地产市场的健康发展,银行的授信限制理所应当地成为了必然。
Property fight house approved by non-state is the house built on the farmers' collective land. It is mainly distributed in the areas of county-level district. It can get 'the property right certificate' approved by village committee or township government, not the property right certificate promulgated by the State Housing Administration Department due to not turning in rendering and transferring land fee. Therefore it is called property right house approved by non-state or property right house approved by township. At present, it is illegal building because of breaking the land administration law as well as not conforming to the relative industrial policy. If it had evolved at random, it would have affected the sound development of the whole housing market, so it is necessary for banks to limit the loan credit.
