摘要
行政许可是指行政机关根据行政相对人的申请,经依法审查,认定其享有特定权利或自由所应具备的条件或标准的行政程序行为。行政许可是一种程序性权力。行政许可除具有行政权的普遍功能外,还有一些不同于其他行政权的显著功能。和其他制度一样,行政许可也无法摆脱利弊共存的辩证规律。行政许可制度的功能能否充分发挥,受制于市场和社会机制的发育状况、行政管理能力和技术水平以及行政机关的施政理念。行政许可是一种"必要的恶"。中外行政许可制度发展的历史,都走过了一条否定之否定的道路。中国必须以贯彻实施《行政许可法》为契机,继续将行政许可制度改革推向纵深。
Administrative permission means the procedural act of administrative organs establishing the conditions or standards for the administrative counterpart to have certain rights or freedom, upon their application and after examination according to law. Administrative permission is a sort of procedural power. Apart from the functions common to all administrative powers, adminis- trative permission has some distinctive functions. Like other systems, administrative permission cannot get away with the dialectic law to have both advantages and disadvantages. The growth of market and social mechanism, the administration and technical competence as well as the administrative concepts could all have influence on the full play of the functions of administrative permission system. Administrative permission is ＂a necessary vice＂. The history indicates that, development of administrative per- mission system at home and abroad all experiences negation of negation. China should take the opportunity of implementing the Law of Administrative Permission to carry on the deepening reform on administrative permission system.
