摘要
不真正连带债务的内部效力就是一个债务人在履行了债务之后能否向其他债务人求偿以及如何向其他债务人求偿的问题。关于内部求偿权的取得,我国应该适用先赔偿后让与的方式。债务人取得内部求偿权后应以自己的名义自行行使或通过诉讼方式行使;其行使范围取决于求偿权产生的依据。
The internal effectiveness of unreal joint and several liabilities is that whether a debtor can claim and how to claim other debtors after he has fulfilled the debt to other debtor. As to the achievement of the internal claims, our country should apply the way-first compensation then transfer. The debtor should exercise the right in his own name or through the proceedings exercise after the achievement of the internal claims; the exercise scope depends on the basis for the claim.
