摘要
刑事被害人国家补偿是指,当被害人在受到犯罪行为侵害而无法从犯罪人处或其他途径获得损害赔偿时,由国家设立专项基金,依法给予其一定物质帮助的一种社会安全及司法保护制度。应当从补偿的对象、补偿的范围、补偿的数额及资金来源、补偿程序等方面来构建我国的刑事被害人国家补偿制度。
The state compensation for criminal victims refers to a kind of social security and judicial protection system that the victim in the criminal acts were not against the criminals or other avenues of compensation for the damage by the state to set up a spe- cial fund to help certain substances. We should construct the state compensation system from the subject of compensation, the scope of compensation, the compensation amount and source of funds and compensation procedures.
