摘要
《反垄断法》在第一条中明确规定了该法的目标,但是如何解读该条规定,以及该条在司法实践中如何发挥指导功能,学界仍然存在分歧。争论的焦点在于:反垄断法的目标究竟是"竞争机制"还是其他"利益"或"价值"以及如何协调它们之间的过渡关系等。在反垄断法即将生效的今天,对其目标的理解已经成为理论和实务界无法回避的问题。
China＇s Anti-monopoly Law prescribes its aim in article one; but there are also different opinions about the meaning and its function. The tip point is that whether the goal of antimonopoly law is competitive mechanism or other benefits and values and the relationship between them in article one.
