摘要
体育标志使用许可是体育组织通过无形资产经营取得发展体育运动资金的主要渠道之一,但这种收益同样面临着风险。通过国内外的法律规定和相关法理,论证了体育标志权人应当对体育标志使用许可产品承担产品责任,但这种责任属于监督责任,应区别于生产者的严格责任,适用过错原则来承担产品责任,并提出体育标志权人如何防范受许产品带来的产品责任风险的对策。
The licensing of the sports mark is one of the funding ways in which the sports organizations run their intangible assets. Meanwhile, it is also a risk. In terms of the relevant regulations and the principles, the paper demonstrated that the sports mark owner should supervise the quality of the licensed product and undertake the licensed product liability which is the negligence duty, and which is different from the product maker's liability. Accordingly, the paper presented some suggestions to prevent the sports owner from the risks of the licensed product liability.
