摘要
我国学界对居住权的引入与否一直存在争议,最终《物权法》并未规定居住权相关制度。本文从居住权设与不设之争议焦点入手,即居住权对我国是否存在价值和居住权在我国是否存在的生存的土壤。认为居住权的弱者保障功能之于我国仍然具有价值,且居住权在我国构建并无障碍,并发现,法国民法、德国民法中所规定的居住权制度已经不是原有的仅具弱者保护意义的居住权制度,而是具有促进财富流转功能的现代居住权制度,而我国学者对居住权的讨论还囿于传统的居住权,这显然是有局限性的。故作者认为,我们应建立兼具弱者保障功能和促进财富流转功能的现代居住权制度。
Is has long been a controversial issue in China's academic circle on whether the right of inhabitation should be establishod or not,at last ,the "Property Law" does not regulate the right of inhabitation. This thesis pays attention to the focus of this issue, which refers to the value of inhabitation rights and practical environment of its ratification. The author maintains that the function of protecting the underprivileged in the traditional right of inhabitation still useful to our country and there is no obstacle to validate this right in China. The author also finds out The Right of Inhabitation of German Civil Code,France Civil Code not only performs the function of protecting the underprivileged, but also the function of promoting the mobility of wealth. And the fact that some Chinese scholars define the right of inhabitation according to the traditional right of inhabitation is obviously false. We should set up modern systems which can not only protecting the underprivileged, but also promoting the mobility of wealth.
