摘要
近些年来我国陆续出台并频繁修改环境法律,但是环境法律实施的效果却不明显,这和环境法律有深厚的科技意蕴密切相关。环境法律规制社会现实的思路与路径上具有科技性,很多环境法律规范就是技术性规范,科学的发展增进了对环境法律因果关系的认识,科技的进步更新了环境法学知识、拓宽了环境法调整的领域。我们应该充分认识与高度重视环境法律的科技内因性,从而完善环境立法和增强环境法律实施的效果。
The successive promulgation and frequent amendment of Environmental Law in China does not produce the effective implementation of the law. This is partly because of the shortcomings of legislative technology, an internal cause of science and technology. The ideas and the approaches of Environmental Law in regulating the social reality are featured by scientific and technical property since not a few environmental provisions and regulations are technical norms. Therefore, the development of science can enhance the understanding of cause-effect relationship in Environmental Law. Moreover, the advancement of technology can update the knowledge of the law and widen the field of its adjustment.
