摘要
民法以市民社会为生存领域和规范空间。但是,民法在控制国家权力培育市民社会方面,存在着功能供给不足的缺陷。市民社会的培育需要宪法对国家权力的控制,宪法对国家权力控制得越严密,市民社会的空间就越宽广,民法规范的空间也就越大。若国家权力脱离了宪法的控制,市民社会难以生存,民法的规范空间也就越小。
The civil law takes the civil society as the survival domain and the standard space, but there are some defects on the civil law to control state power to cultivate resident of a civil society, the civil society＇s cultivation needs the constitution to control state power. The constitution control the state power more strictly, the civil society＇s space is broader, the civil law standard space is also bigger.
