摘要
经济犯罪中死刑的存置尚有一定的生命空间,但更不应忽视的是其生命空间的萎缩性与内部的不和谐性。死刑在经济犯罪中的存置经历了一个由广泛扩展再到适当限制的嬗变过程。其存置在价值层面尚有一定的合理性,但也孕育了不合理性的基因;传统刑法文化对实定刑法产生了根深蒂固的影响,重刑、泛刑、死刑以及宗法文化的发达与现代社会的法治刑法文化观念,发生着剧烈的碰撞与冲突。而传统文化的惯性对一国的经济犯罪中死刑的存废始终存在着或多或少的影响;无论是中国社会偏重伦理学角度的"性善"与"性恶"的人性之争,还是西方社会偏重法哲学角度的"理性"与"经验"的人性之争,都有难以克服的局限性。经济犯罪中不论是主张存置死刑抑或还是废除死刑,均有支撑其存在的人性基础。
It should be noted that the death penalty still kept some life space in economic crime, but more importantly, what should not be overlooked is that this life space is becoming shrinking and full of internal disharmony. The death penalty in economic crime has undergone of a process from a broad expansion to appropriate restrictions. Its existence in the value level has certain rationality, but also breeds an unreasonable gene. The traditional culture exerts a deep-rooted impact to the Criminal law. The heavy penahy, broad penalty, death penalty and the developed patriarchal culture are incompatible with the modern penalty values. And the inertia of the traditional culture seems to have a more or less effect to the idea that whether the death penalty should be abolished or reserved in economic crime. Whether the dispute over "good nature" and "bad nature" from the perspective of Ethics in China or the dispute over "rational" and "experience" from the point of view of philosophy in the west, there are still some limitations. As a matter of fact, the views of advocating or abolishing death penalty in economic crime have their human base.
