摘要
农村社会转型、土地价值的发现、妇女维权意识的觉醒产生了以土地征用补偿费分配为核心的所谓"农嫁女"权益问题。而其焦点村集体经济组织成员资格之争暴露出的是我国农村社会转型过程中生产力发展和上层建筑某些方面相对滞后的矛盾。由于各种体制性障碍的存在,使其解决成为政府部门棘手的难题。现有经验表明,从立法、行政、司法入手,并以农村集体所有制改革相配套,是解决这一难题的有效途径。
The problem on rights of ＂The Migrated Married Rural Women＂, which focuses on me distribution of compensation fee for land requisition, arises on the basis of the social transition in rural areas, the discovery of land value and the awakening of women＇s awareness of right protection. And the dispute on collective economic organizations membership has fully exposed the conflict between the. development of productive forces and the stagnation of certain aspects of the superstructure in the course of rural social transition. The solving of this problem has become a sticky business for the government due to a variety of structural obstacles. Consequently, the only effective solution is to rely on the legislative, executive and judicial, supported by the reform of the rural collective ownership.
