摘要
农民专业合作社一直被视为是实现农村经济规模化、产业化经营,促进社会主义新农村建设的重要推动力量。随着我国《农民专业合作社法》的施行,全国各地各种类型的农民专业合作社相继设立。然而,在法律的贯彻和实施中,如果不能深刻理解农民专业合作社的民间性、专业性和民主性,不能对由农民专业合作社的特定属性所要求的法律实施机制进行正确认知,那么不仅法律实施的过程不会平坦,甚至立法的本意也有被扭曲之虞。
Farmers cooperatives have been as the important driving force to realize rural economies of scale and industrialization. While as （Law of Farmers Cooperatives） has been put in force since July lst,2007.All kinds of farmers cooperatives have been set up in whole country.However,if we can＇t understand the nongovernmental nature,professional nature and democratic character of farmers cooperatives,nor have right cognition on the legal enforcement system to accord with the special quality of farmers cooperatives,the process of law enforcement will be not smooth,even the original idea of legislation will be distorted.
