摘要
在国家第三次修改专利法及其实施细则之际,职务发明制度再度引起人们的广泛关注。从发达国家职务发明制度中利益分配机制的比较研究得出:利益平衡是职务发明制度中利益分配的原则,并依此原则对我国职务发明制度提出修改建议:在权利分配上采取类似于德国的分配方案,并采取类似于日本的程序设计以保障发明人获得合理报酬。
At the third amendment on the patent law and its detailed rules,the system of service invention takes our attention again. From the comparative study on the distribution mechanism in the system of service invention,this paper concludes that the principle is the interests balance between employer and employee.Then advice is put forward that we can adopt the pattern of the system in Germany and Japan.
