摘要
以尊重实定宪法的立场和法解释学的方法来看,宪法中的公民义务规定具有一些合乎立宪主义精神的法律作用。其中,纳税、服兵役这类强制性义务具有限制公民权利与控制国家权力的双重作用,但主要作用在于控权;受教育、劳动这类福利性义务具有督促国家履行相应职责的功能,其控权功能弱于强制性义务。
In the view of treating the positive constitution seriously and the method of legal interpretation, the citizens＇＂ obligations provision in the constitution have some legal functions matched with the constitutionalism. The compulsive obligation has both the functions of restricting citizens＇ fights and controlling nation＇ powers, but the latter is the primary; the welfare obligation has the function of supervising the nation to carry out its corresponding responsibilities, the power-controlling function is weaker than in the compulsive obligation.
