摘要
网络环境是人类社会环境在信息时代的特殊表现,是以计算机互联网为载体,以信息技术为支撑的全新信息环境。网络环境赋予了人类更广泛的信息自由,推动了民主的进程,深刻改变了人们的民商事活动,也为社会文明提供了新的发展动力。与此同时,网络环境下的社会关系日益复杂,权利认同的社会基础正不断受到冲击,权利冲突和权利泛化等现象不断出现,这些都直接改变了人类对权利的看法,使得传统的权利理念面临着巨大的变革。因此,有必要将传统权利理论纳入到网络环境中进行重新定位和理性考察。
Network Environment has given mankind a wider freedom of information, and promoted the democratic process, greatly changed people＇s civil and business activities, and provided a new impetus to the development for civilized society. At the same time, with social relations of the network environment being increasingly complex, the social foundation of recognized rights has been increasingly challenged, right conflicts and pan-right came into appearance, all these has changed people＇s perspective on rights, and threatened to revolutionize the traditional perception of rights. Therefore, it necessitates to catergorize the traditional perception of rights into the network environment and relocates and rationalizes it.
