摘要
旧城改造政策涉及到的主体有地方政府、旧城改造的开发商和旧城区的房产所有人三大主体,利益呈现非均衡状态分布。由于存在滥用公共利益的现象,旧城改造政策遭遇了合法性危机。为确保对房产所有人的利益补偿,确保为公益的目的性,应抑制地方政府逐利冲动,强化公共性,创立旧城改造政策议程必须公开透明,增强房产所有人的组织性,完善拆迁许可程序。
Three main bodies are concerned in the reconstruction policy of cities' s old districts including local governments, the real estate developer and house property proprietors. And it si uneven in the benefits distribution. Beccause of the phenomenon of abusing public benefits, the old city recon- struction policy has encountered legitimacy crisis. To guarantee the compen- sation m^d the purpose of public benefits, we should take drastic measures to restrian Iocal governments from chasing interest, ensure publicity and trans- parency during the course of policy agenda, make the house property propri- etors form a organization of defending rights and interests, improve and perfect the permission orocedure of dismantling.
