摘要
在机构知识库的资源建设过程中,复杂资源产权现状会给机构知识库带来各种潜在的法律风险。本文从权利所有人的角度对机构知识库存储的各种资源进行分类,明确了各种资源的产权现状。介绍了机构知识库产权管理的策略和法律工具——存储许可协议,强调规范的存储许可协议可以帮助提交者和机构知识库确定各自的权利和义务,并介绍了存储许可协议的主要内容。
In the construction of information resources in institutional repositories, the complicated property right status of different resources will bring potential legal risks. This paper classifies the resources in institutional repositories in accordance with the ownership of the property right, and clarifies the property right of various resources. It introduces the strategies for the property right management of institutional repositories and the legal tool, i. e. the deposit licence, and emphasizes that normalized deposit licence will help make the depositors and the institutional repositories clear about their own right and duty. The paper also gives a description of the main content of the deposit licence.
